How Do I Get My Accident/Crash Report from the DMV in Charlotte, NC?

An ongoing lawsuit concerning the release of reports by the NC Division of Motor Vehicles (DMV) has resulted in substantial delays for administering accident reports, making it challenging for people to move forward with their personal injury claims and other important processes.
For this reason, if it is difficult for you to obtain your accident report in Charlotte, know that you are not alone.
The lawsuit filed in 2019 against LexisNexis regarded obtaining crash reports through the publicly accessible online portal. Plaintiffs Deloris and Leonard Gaston alleged that LexisNexis violated the Driver’s Privacy Protection Act (DPPA) by obtaining personal information for unlawful purposes, such as processing, re-disclosing, and reselling such information.
On September 2, 2020, Judge Bell limited the class of plaintiffs allowed to make a claim under this action. Second, he found that Plaintiffs were entitled to summary judgment on their claim for injunctive relief, requiring LexisNexis to immediately stop public access to its online portal.
This case was settled in November 2020. What was the impact?
The Charlotte-Mecklenburg Police Department removed links on their site that provided public access to crash reports on LexisNexis. In other words, accident reports are no longer released nor accessible online. Instead, you must mail a request to the NC DMV and pay a fee to have the report mailed to you, which oftentimes takes 15 days or more.
How to Request a North Carolina Crash Report from the DMV

There are three ways you may obtain copies of crash reports from the Division of Motor Vehicles in North Carolina.
The Division of Motor Vehicles will provide certified copies of crash reports for $5.50. Payment can be made by credit card or check/money order made payable to NCDMV.
